Section 1332 of the Patient Protection and Affordable Care Act gives states the option to apply for a State Innovation Waiver. Such a waiver allows states to waive some, but not all, requirements of the ACA related to marketplace health insurance and to implement innovative ways to increase access to quality health care.

Whether and how Texas pursues a State Innovation Waiver will be up to the state legislature. THA will work with lawmakers during the interim to review the possibilities for how a waiver could be used.
