Director and Trustee Liability

Alex Fuller and Brian Jackson
Fuller and Jackson will discuss director and trustee liability for health care providers. The presentation will review current litigation issues facing providers and their directors, and future liability issues relating to compliance, fraud and medical staff issues.

 

Hospital Risk Management: What the Board Needs to Know
Wednesday, Oct. 27, Noon – 1:00 p.m. Central
Barry Couch
The hospital is a “city of risk” that must be managed on an enterprise-wide basis. Couch will outline the key questions to ask and the information to expect from hospital administrators responsible for assuring that your patients and your financial assets are protected. The four domains of risk will be clearly identified as well as the areas that must be coordinated to reduce, eliminate or transfer the potentially severe exposures that can diminish hospital assets.

 

Conflict of Interest

Brown will provide an overview of conflict of interest provisions applicable to public and nonprofit hospital board members.


Speakers

Alex Fuller is a senior shareholder at Davis Fuller Jackson Keene in Austin, where he has practiced since 1979. He earned his J.D. from the Bates College of Law, University of Houston and was admitted to the bar in 1976. Fuller serves as adjunct professor at the Graduate School of Hospital Administration at Trinity University in San Antonio. He is a member of the Austin, Williamson County and American Bar associations, State Bar of Texas and National Health Lawyers Association.
Brian Jackson is a senior shareholder at Davis Fuller Jackson Keene in Austin where he specializes in health law and defending health care providers in medical malpractice cases. He also advises hospitals and hospital boards on regulatory issues, contractual issues, reimbursement disputes, and governance issues. Jackson and the law firm represent more than 100 hospitals across Texas as well as the Texas Hospital Association, the Texas Hospital Insurance Exchange and the Texas Pharmacy Association.
Barry Couch is president and founder of HealthSure, a Texas-based specialty insurance, risk management consulting firm. He has served on the boards of King’s Daughters Hospital in Temple, Texas Hospital Association and HOSPAC and as chairman of Texas Healthcare Trustees. He has achieved the professional designations of certified insurance counselor and associate risk management and is a licensed risk manager. He has written numerous articles on health care risk management concepts and frequently presents to health care organizations and trade associations.
Fletcher Brown is a shareholder at Davis & Wilkerson, PC, where his law practice focuses on administrative, health, transactional and governance matters related to hospitals, physicians and other health care providers. Brown’s experience includes general counsel services to numerous public and nonprofit hospitals, licensing and regulatory matters for health care facilities and physicians before a variety of state and federal agencies. He currently is the president of the Health Law Section of the Austin Bar Association.
