Red Flag Rules: Strategies for Implementing an Identity Theft Protection Program

The Red Flag Rules, issued by the Federal Trade Commission and other federal agencies in 2007, are designed to detect, prevent and mitigate identity theft from a hospital's patient accounts and any other debtors' accounts. The rules require financial institutions and creditors which hold consumer or other “covered accounts” – likely including most hospitals – to develop and implement an identity theft prevention program by Nov. 1, 2008. Enforcement of the rules has been suspended until Aug. 1, 2009. This recording of an audioconference presented on March 10, 2009, will help hospitals comply with the Red Flag Rules by reviewing best practices for an effective identity theft prevention program.

Patterson has represented health care providers for more than 30 years, is certified in the specialty of health law in Texas, is a past chair of the Health Law Section of the American Bar Association and is a frequent speaker on health law topics. He graduated with honors from Southern Methodist University’s Dedman School of Law. Gwen Chapman is an associate in the health law department of Fulbright & Jaworski LLP. Chapman has focused her practice on regulatory compliance and reimbursement issues for a broad range of health care industry organizations, including hospitals and medical device companies.
